Confiscation proceedings for approximately £70,000 were stopped against two Defendants who had stolen laptops. His Honour Judge Geake determined that the continuance of the confiscation proceedings amounted to an abuse of process. Patrick Cassidy, Counsel for one of the Defendants, argued that since all parties had recovered the missing items and the Defendants has repaid one supplier for their loss, the only losers were the Defendants and using the recent case of Shabir and Morgan 2009 Cr App Rep (S), the proceedings were oppressive.
